Mark Health Law has successfully represented individuals, classes, organizations, and state attorneys general in litigations and investigations challenging unequal access to health care.

Represented the State of New York in the litigation brought by twelve state Attorneys General against the U.S. Department of Labor challenging the Association Health Plan Rule, which sought to exempt associations of small employers and sole proprietors from the ACA's consumer protections.

Represented the State of New York in the litigation brought by five state Attorneys General against the U.S. Department of Health & Human Services challenging rules significantly expanding religious and moral exemptions to the ACA's requirement that insurance cover contraceptive care.

Represented retired New York City public servants in litigation against the City of New York and EmblemHealth insurance challenging changes in retirees’ health care benefits (affirmed on appeal).

Represented retired Delaware public servants in litigation against the State relating to its’ attempt to move retirees from a Medicare supplemental plan to Medicare Advantage plan.

National Opioids Investigation & Litigation

Co-led New York and 40 other state Attorneys General investigation of and settlement with the “big three” opioid distributors.

Lead Paint Poisoning Investigations & Settlements

Co-led multiple investigations and settlements for violations of the Childhood Lead Poisoning Prevention law. See here, here and here.

Covid-19 Vaccine Investigations & Settlements

Led multiple investigations and settlements with Covid-19 vaccine providers that created barriers to access for Covid-19 vaccines.

Led multiple investigations and settlements with companies selling products fraudulently advertised as preventing illness from the Zika virus.
